If you’re concerned about the remaining balance from a repossessed Auto Loan, or if you know you simply can’t afford to keep up your Vehicle Loan Payments, please read the next post to learn some time-tested tips to help you navigate the Statue of Limitations for that debt.
As you may already, know the Statue of Limitations (SOL) is the amount of time that a business or Debt Collector can ‘Leally’ collect on a defaulted loan.
What You May Not Know about the SOL May Cost You – Over the Long-Haul.
For example, once the the Statue of Limitations has passed for an account, the debt connected to it is considered ‘Time-Barred’. This simply means that the Debtor (2nd Party) can not be held liable to repay the debt. But even after a debt is Time-Barred, collection of the Debt can still be pursued.

Time Does Not Bar Debt Collector Harassment
Tammy was a 30 year old woman from the the Philly Area. She had enrolled with the Bankruptcy Prevention Law Firm that I (formerly) worked at, because honestly, Tammy didn’t know her rights.
You tell by the words that Tammy used, that she was not educated about her rights. Tammy was also a little naive. In spite of this, Tammy was a good person.
8 years before I met Tammy, She had co-signed an Auto Loan for with a Dead-beat ex-boyfriend. 8 years later, Tammy was getting calls at work, from a Debt Collector about the remaining balance on a repossessed Car Loan.
Tammy had made the mistake of making a “good faith payment” on the ‘Deficiency Balance (a.k.a. the remaining debt) on the loan she co-signed.
The debt collector told Tammy that if she was to make a good faith payment on the account, the harassing phone calls would end. Tammy made the payment but the calls didn’t end as promised. In fact, Debt Collectors started calling Tammy from different numbers and much more often than before. Tammy’s boss told the Debt Collectors that, “Tammy can’t get calls at work”.
But the Debt Collectors replied, “if she (Tammy) met her obligation to pay the debt they wouldn’t have to call”.
Time Was on Tammy’s Side
The problem was that this Debt Collector had no right to call Tammy in the first place
! After I looked into the Statue of Limitations for Tammy’s Car Loan, I discovered, that The debt in question was “Time-Barred”. I immediately informed Tammy that her debt had passed the SOL by over 4 years. Tammy was shocked at first. Then she said, “J. don’t take this wrong, but I love you”. I was happy to inform her of her rights.
