What should you do if you receive a Summons for a debt? Read the whole post for some high quality answers.
You may be asking, “what Is A Summons to Court“?
In plain-speak, a Summons is part of a Law Suit. When someone (“Plaintiff”) files a “Complaint” with the Court, the “Defendant” is responsible for “answering” the Complaint. The Summons may be delivered with the Complaint.
In 2009 I predict an unprecedented amount of Law Suits for Credit Cards by Sallie Mae and others will be filed - forcing the Consumer / Debtor / Defendant to answer.

While Legal Assistant in a Bankruptcy Prevention Law Firm, I’ve dealt with Attorneys so I have respect for their ability to get their way legally. Many people don’t know that it’s not just an Attorney or Law Firm, that has the right to serve a Complaint and Summons to Court. I’m not an Attorney they work too hard
but I know that anyone can file a Complaint against another person or business. This is why it’s important to have an Attorney to represent you.
Any business can file a Complaint with the Court for an alleged debt.
Case in point, Arrow Financial sent a letter to a man in Allentown, Pennsylvania

“I had been surprised to read in a certified letter that Arrow Financial Services is taking me to court even though I did not receive any letter from them – for the wrong amount, like almost 900.00 more dollars without proof I and disputing the case before I go to court with the General Attorney”
I’ve Managed a bunch of accounts (for clients) in the hands of Arrow Financial. With Arrow, it’s just business.din’t din’t scream or threaten my clients (like other Debt Terrorist) but they are quick to file a Law-Suit. See Arrow Financial is a Professional Debt Collection Company. Arrow Financial is now owned by Sallie Mae.

Arrow Financial is professional but quick to sue (especially on Debts for Credit Cards).
So what can you do if you’re sued for your debt?
There are a vast amounts of rumors and myths about what to do if you’re sued. Let me break down the 3 most important actions to take (as a Consumer / Debtor / Defendant) when you are sued for a debt.
1.) Know your responsibilities:
- You have to respond according to the rules of your State.
- Don’t avoid opening certified mail. Some states may allow a Summons to be “Served” by mail.
- You may have to appear in Court for the account. Make provisions to be in Court on the date.
- Call your County Clerks Office and ask them what are your responsibilities regarding the Case.
- Know what documents have to be completed and when.
- You may have to show up in Court. If you don’t show you may loose by “Default”.
2.) Learn Your Rights:
- Has the debt been Validated? You may still have the right to Validate the debt (depending on your State), after you are sued by a Debt Collector.
- If you go to Court to defend yourself for the Debt, you don’t loose automatically. You’ll still have the right to defend yourself.
- You have the right to an Attorney. It’s best to hire a Lawyer that knows the Laws of your particular State. You don’t have to go into deeper debt trying to defend yourself against a Law Suit. Check out Pre-Paid Legal Services.
3.) Take Action:
- It is very possible to successfully defend yourself against being sued. If you take the steps above, you should be fine.
- Hire a Consumer Attorney located in your State. A good Consumer Attorney (like the ones offered by Pre-Paid Legal Services), know the Laws of your State. A good Lawyer can determine the best defense for you, based onexperience.
